Peak Builders provides an AI-powered business operations platform that includes:

- CRM & Lead Management: Contact management, lead tracking, pipeline management, and customer relationship tools.
- AI Agents: Intelligent automation agents that can handle communications, scheduling, data entry, and other business tasks.
- Communication Tools: Multi-channel communication including email, SMS, voice, and social media messaging.
- Website Builder: Tools to create and manage business websites with integrated lead capture.
- Marketing Automation: Email campaigns, social media management, and marketing workflow automation.
- Accounting Integrations: Connections to QuickBooks, Xero, and other accounting platforms.
- Scheduling: Appointment booking, calendar management, and automated reminders.
2.2 AI Capabilities
Our AI features use machine learning and natural language processing to automate routine business communications, provide intelligent suggestions and recommendations, generate content and responses (subject to your review), analyze data and provide insights, and power virtual assistants and chatbots.
3. Account Registration and Security
3.1 Account Requirements
To use our Services, you must be at least 18 years of age, provide accurate and complete registration information, maintain the security of your account credentials, notify us immediately of any unauthorized access, and not share your account with unauthorized users.
3.2 Organization Accounts
If you create an account for a business or organization, you represent that you have authority to bind the organization, you are responsible for all activity under your organization account, and you must ensure all users comply with these Terms.
3.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials, all activities that occur under your account, immediately notifying us of any security breaches, and using strong, unique passwords.
4. Acceptable Use
4.1 Permitted Uses
You may use our Services only for lawful business purposes and in accordance with these Terms.
4.2 Prohibited Activities
You agree NOT to violate any applicable laws, regulations, or third-party rights, engage in fraud, money laundering, or other illegal activities, transmit viruses, malware, or other harmful code, send spam, phishing messages, or unsolicited communications, create or distribute illegal, harmful, or offensive content, attempt to gain unauthorized access to any systems or accounts, interfere with or disrupt the Services or servers, circumvent any access controls or security measures, use AI features to generate content that violates these Terms, or represent AI-generated content as human-created without disclosure.
5. Third-Party Integrations
When you connect third-party services (Google, Facebook, QuickBooks, etc.), you authorize us to access and use data from those services, agree to that service terms and privacy policy, and understand that we cannot guarantee the availability of third-party services.
You are responsible for ensuring you have rights to connect third-party accounts, reviewing permissions granted to Peak Builders, managing and revoking access as needed, and complying with third-party service terms.
6. Payment Terms
6.1 Subscription Plans
Our Services are offered through various subscription plans. Pricing and features are available on our website.
6.2 Billing
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as stated in these Terms. Payments are processed securely through Stripe.
6.3 Price Changes
We may change our prices with 30 days notice. Price changes will apply to the next billing cycle after the notice period.
7. Intellectual Property
7.1 Our Intellectual Property
Peak Builders and its licensors own all rights to the Services, software, and technology, our trademarks, logos, and brand elements, documentation, designs, and other materials, and AI models and algorithms. You may not copy, modify, distribute, or create derivative works without our written permission.
7.2 Your Content
You retain ownership of content you create or upload. By using our Services, you grant us a license to host, store, and display your content, process your content to provide the Services, and create backups and maintain system integrity.
8. AI Services Disclaimer
8.1 AI Limitations
Our AI features are designed to assist, not replace human judgment. AI outputs may contain errors or inaccuracies, be incomplete or outdated, require human review and verification, and vary in quality and appropriateness.
8.2 Your Responsibility
You are responsible for reviewing AI-generated content before use, verifying accuracy of AI recommendations, ensuring AI outputs comply with applicable laws, and not relying solely on AI for critical decisions.
8.3 Not Professional Advice
AI outputs are NOT substitutes for legal advice from qualified attorneys, medical advice from healthcare professionals, financial advice from licensed advisors, or any other professional expertise.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY OR COMPLETENESS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELLO NATIVE AI SHALL NOT BE LIABLE FOR indirect, incidental, special, consequential, or punitive damages, loss of profits, revenue, data, or business opportunities, damages arising from your use of third-party services, or damages exceeding the amount you paid in the 12 months prior to the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Peak Builders, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, your violation of any third-party rights, or your content or data.
12. Term and Termination
12.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
12.2 Termination by Us
We may suspend or terminate your access if you violate these Terms, your payment fails and remains unpaid, we are required by law, or we discontinue the Services with reasonable notice.
12.3 Effect of Termination
Upon termination, your access to the Services will end, we will retain your data for 30 days then delete it, and certain provisions of these Terms survive termination.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13.2 Arbitration
Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in court.
14. General Provisions
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peak Builders. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not waive our right to enforce it later. We may modify these Terms at any time with notice.
